1. These Terms sets forth the terms and conditions that apply to the sale and purchase of the products between ATD Retails Pvt Ltd and you. Change in law or changes in ATD Retails Pvt Ltd business may require changes to be made to the Terms from time to time (“Revised Terms”). As such, ATD Retails encourages you to review the Terms and any other terms and condition periodically for any such changes. It is your responsibility to carefully read, agree with and accept the terms or any other terms and condition.
2. You agree that ATD Retails Pvt Ltd makes no warranty as to the accuracy, comprehensiveness, or correctness of any Product(s) on the Website www.myshopbazzar.com (“Website”) and provides all Product(s) on an "as is" basis.
3. The products/services and information displayed on the Website is an "invitation to offer" to public at large. Your order for purchase constitutes your "offer" which shall be subject to acceptance or rejection by Myshopbazzar.com and shall further subject to the terms and conditions as listed below. All accepted offers shall be fulfilled by ATD Retails Pvt Ltd. If you have supplied your valid email address or contact number, Myshopbazzar.com will notify you by email or through SMS (as the case may be) as soon as possible to confirm receipt of your order and email you again to confirm details and therefore process the order. Acceptance of your order will take place upon dispatch of the Product(s) ordered. No act or omission of Myshopbazzar.com or ATD Retails Pvt Ltd prior to the actual dispatch of the Product(s) ordered will constitute acceptance of your offer.
4. Persons who are "incompetent to contract" under the Indian Contract Act, 1872 including minors, un-discharged insolvents etc… or otherwise barred by law are not eligible to place the order for the product or use or transact on the Website. Persons under the age of 18 years cannot transact through or use the Website. Website is freely accessible to the all the end user however subject to the terms of use and privacy policy or any other terms and conditions.
5. For the purpose of these Terms of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a buyer on the Website by providing Registration Data while registering on the Website as Registered User using the computer systems. Myshopbazzar.com allows the User to surf the Website or making purchases without registering on the Website. The term "We", "Us", "Our" shall mean ATD Retails Pvt Ltd
Your Account and Registration Obligations
If You use the Website, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Website and refuse to provide You with access to the Website.
Platform for Transaction and Communication
The Website is a platform that Users utilize to meet and interact with one another for their transactions. Myshopbazzar is not and cannot be a party to or control in any manner any transaction between the Website's Users.
Henceforward:
1. All commercial/contractual terms are offered by and agreed to between Buyers and Sellers alone. The commercial/contractual terms include without limitation price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to products and services and after sales services related to products and services. Myshopbazzar does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the Buyers and Sellers.
SERVICES, ORDER, PRICING AND PAYMENT:
1. The Services shall include:
a. Supply of the ordered product to you through the seller.
b. Procuring a logistics company experienced with collection and transportation to deliver your ordered Products (“Logistics Supplier”).
c. Myshopbazzar customer support, enabling you to contact Myshopbazzar.com at customercare@myshopbazzar.com with any queries that you may have in relation to your purchased Product/s.
2. You agree to pay the full amount payable for the Product as indicated during the order process, including any shipping costs or charges incurred with that order. All prices are displayed and are payable in Indian National Rupees.
3. Myshopbazzar.com may not accept your order for Products if (a) the item/s is/are out of stock; (b) Myshopbazzar.com is unable to obtain authorization for your payment; (c) shipping restrictions apply to a particular Product / Location; (d) Myshopbazzar.com finds a Product or pricing error; or (e) for any other reason at Myshopbazzar.com’ s sole discretion. In any of these situations, Myshopbazzar.com will inform you that your order has not been accepted, will not process your payment and will not be liable to you or any third party by reason of our decision to decline processing an order, or unwinding or suspending any transaction after processing has begun.
4. From time to time there may be errors in the pricing that appears on the Website or during the order process. There may also be errors in transmission resulting in the interruption of your purchase. Without admissions, Myshopbazzar.com will in good faith try to resolve any issues that may arise as a result of such errors. You agree to cooperate with Myshopbazzar.com to resolve such issues, and you agree that Myshopbazzar.com shall have full discretion to determine the appropriate resolution in such cases.
5. While availing any of the payment method(s) available on the Website, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to:
1. Lack of authorization for any transaction/s, or
2. Exceeding the pre-set limit mutually agreed by You and between "Bank/s", or
3. Any payment issues arising out of the transaction, or
4. Decline of transaction for any other reason/s
6. Myshopbazzar.com may offer multiple payment options through various instrument(s) or mode(s) for the convenience of the customers. Myshopbazzar.com reserves the right to add or remove or modify the terms and conditions for such payment options without prior notice. Without prejudice to the aforesaid, usage of any of the above payment options shall at all times be subject to rules, regulations and guidelines under applicable law and those prescribed by RBI, issuer banks, acquiring banks, facility providers and other intermediaries involved in the payment process.
7. All payment transactions are subject to validation by the issuer as applicable. If the issuer of your payment instrument(s) refuses to authorise payment, Myshopbazzar.com has the right to cancel the order. Myshopbazzar.com cannot be held responsible if this should result in a delay in dispatching your goods/Products.
8. Myshopbazzar.com reserves the right to refuse to process transactions by buyers with a prior history of questionable charges including without limitation breach of any agreements by buyer with Myshopbazzar.com or breach/violation of any law or any charges imposed by issuing bank or breach of any policy.
9. Myshopbazzar.com may do such checks as it deems fit before approving the receipt of/buyers’ commitment to pay (for Cash On Delivery transactions) transaction price from the Buyer for security or other reasons at the discretion of Myshopbazzar.com. As a result of such check if Myshopbazzar.com is not satisfied with the creditability of the buyer or genuineness of the transaction/transaction price, it will have the right to reject the receipt of/buyers’ commitment to pay transaction price.
10. All billing and registration information provided must be truthful and accurate. Providing any untruthful or inaccurate information constitutes a breach of these Terms. By confirming your purchase at the end of the process, you agree to accept and pay for the item/s requested.
11. Certain orders may constitute improper use of the Website and Services. Myshopbazzar.com reserves the right, at its sole discretion, to refuse or cancel any order for any reason. Your Account may also be restricted or terminated for any reason, at Myshopbazzar.com sole discretion.
12. In the event that a Product is listed at an incorrect price due to an error in pricing, Myshopbazzar.com shall have the right, at Myshopbazzar.com discretion, to refuse or cancel any orders placed for that Product. In the event that a Product is mispriced, Myshopbazzar.com may, at Myshopbazzar.com’s discr-etion, either contact you for instructions or cancel your order and notify you of such cancellation.
13. Myshopbazzar.com reserves the right, at its sole discretion and without prior notice, to limit the quantity / value of items purchased per person per household or per order. These restrictions may be applicable to order placed by same account, the same credit card and also to orders that use the same billing and/or shipping address.
SHIPPING
14. Delivery charge varies with each Seller. Sellers incur relatively higher shipping costs on low value items. In such cases, charging a nominal delivery charge helps them offset logistics costs. The delivery charge may be waived off by some Sellers, if you shop with them for a minimum predefined value.
15. For Myshopbazzar.com or the seller to arrange to deliver any Products that you have purchased, you shall be solely responsible for providing the correct and accurate postal details.
16. Should you receive an item that is not
RETURNS
17. Myshopbazzar.com wants you to be pleased with your purchase, and so if for any reason you are not completely satisfied, Myshopbazzar.com will accept return of your purchase, subject to terms and conditions for returns mentioned as follows:
We are committed to ensure your satisfaction of any product that you have ordered from us. If you are not satisfied with any product, we will accept returns within 10 days as per below mentioned terms:
a. In the unlikely event that any product you have ordered from us is not received in good condition, is damaged or defective, or if product delivered is different from what you had ordered, you may return the product unused, in the same condition as you had received it, in its original packaging along with original tags, for an exchange, within 10 days from the date on which these goods are delivered.
b. The complain will be entertained only if you have lodged a written complain within 24 hours of the receipt of the product from the delivery person/courier to us in info@myshopbazzar.com, customercare@myshopbazzar.com with details of your order and the problem.
c. Please do not accept delivery of any item whereby the outer packaging is damaged or tampered with in any manner. Please contact customer care if you open the packaging and discover that the item is damaged.
d. Products damaged while being used do not qualify for a refund or replacement.
Note: Products that have been assembled and/or installed cannot be returned in this manner. These include furniture and consumer durables, electronic products such as Mobiles, TVs, fridges, washing machines or air conditioners or any electronic products ,Please contact your local authorized service centre of the manufacturer for such products, and follow their instructions.
Note: Personal items including Lingerie are excluded due to hygiene reasons.
Returns through Courier:
a. Please ensure that, we receive the return product within 10 days of having received the product and request an exchange. However you can avail this facility only if you have lodged a written complain within 24 hours of the receipt of the product from the delivery person/courier to us in info@myshopbazzar.com, customercare@myshopbazzar.com with details of your order and the problem.
b. We will bear the cost of courier charges/VPP and shall process the exchange subject to receipt of the products at our location in unused condition and in its original packaging along with the invoice and only if there has been an error on our part in terms of dispatching a damaged/ defective product/ different product/ different size than what you have ordered.
Please note that in case you have placed a particular order and we have dispatched the product conforming to your order and subsequently you wish to return the product the courier charges for returning the product to us will NOT be reimbursed by us and will be borne by the customer.
Refunds
a. Only in cases if we are unable to replace the damaged / defective product, we will refund your amount.
b. In other cases only exchange of other products of same value or more value (differential amount will be charged) will be considered.
c. We will refund the money the way the payment was made. If the payment was by Credit Card or Net-Banking, we will refund the Credit Card or Net-Banking account. If the payment mode was Cheque or DD, we will send you a cheque (not a DD). Cheques will be sent only to the billing address of the customer.
d. The refund process will be initiated once we have received the product(s). Typically refunds are processed in less than 10 working days but in case of payments by Cheque or DD, it may take a few extra days for the cheque to be delivered to your billing address, and for the funds to be credited to your account, once you deposit the cheque.
e. Refunds are not offered for electronic items. All sales are final.
Replacements are offered only if the product was received in damaged condition. For all other device-related issues, please contact the brand authorized service centre directly
Please note that we shall not be responsible for any delays in credit to the Cardholder's credit card account as that is managed by the Cardholder's issuing bank.
18. All payments made by you towards correctly returned Products will be refunded as per the Returns Policy & Returns Process. If you think that we have provided you with an incorrect refund, please contact us immediately on customercare@myshopbazzar.com.
COUPONS
19. Any coupon/ voucher issued by Myshopbazzar.com can be used only once, on or before its validity date mentioned on the coupon.
20. Only one Coupon/ Voucher will be applicable for one single transaction.
21. No duplicate coupon/ voucher will be issued is case of lost or misplace.
22. The holder of the gift coupon is deemed to be beneficiary.
23. The validity period of the gift voucher will not be extended under any circumstance.
24. Coupons of INR 500 should be applicable only on purchase of INR 1499 and above & Coupons of INR 250 shall be applicable only on purchase of INR 999 and above.
REWARD POINTS
25. Customers are rewarded with (10) point of every purchase of INR 100.
26. One reward points is equivalent to One Rupee
27. 100 reward points mandatory to be maintained in the customer’s account, over and above the initial 100 points, the rest can be redeemed.
28. Only 100 rewards points can be applicable/ redeemed on one transaction.
29. 2 points on sharing or liking products on MSB through social media such as Facebook, Twitter & Google+.
30. On registration or subscribing news letter, 10 points will be added to the customer sign up.
31. 5 points rewarded to customer on review of any product (with a cap of max 50 points per customer)
32. 2 points if customer tag the product (with a cap of max 100 points per customer)
33. 5 points to be added on customer account in lieu of his/her birth day if the same is mentioned during the registration process.
Mobile APPs
34. On download of application, 1000 reward points are added to the customer’s account as a welcome gift which he/she can redeem in four transaction availing 250 points on each transaction (equivalent INR 250). This one set of 250 points can be redeemable on shopping of INR 1499 and above.
GENERAL
35. If any provision of these Terms and any other terms and condition is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable and the other terms of these Terms and any other terms and condition shall remain in full force and effect. The failure of Myshopbazzar.com to act with respect to a breach of these Terms by you or others does not constitute a waiver and shall not limit Myshopbazzar.com rights with respect to such breach or any subsequent breaches.
36. These terms and any other terms and condition shall be governed by the laws of India.
37. You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you, Myshopbazzar.com and ATD Retails Pvt Ltd as a result of your use of this Website.
38. A reference to the Website in these Terms includes the website URL www.myshopbazzar.com and any successor website URLs.
39. These Terms (i) constitute the entire agreement between you and Myshopbazzar.com with respect to the subject matter hereof and supersedes any previous oral or written arrangements or understandings relating thereto, (ii) may not be assigned or resold, in whole or in part, directly or indirectly, by operation of law or otherwise, by you.
40. Myshopbazzar.com shall be not held liable for any delay or failure in performance of any part of these Terms from any cause beyond our control and without our fault or negligence, such as acts of God, acts of civil or military authority, current laws and regulations and changes thereto, embargoes, epidemics, war, terrorist acts, riots, insurrections, fires, explosions, earthquakes, nuclear accidents, floods, strikes, power blackouts, volcanic action, political unrest, other major environmental disturbances, unusually severe weather conditions, acts of hackers and other illegal activities of third parties, inability to secure products or Services of other persons or transportation facilities, or acts or omissions of transportation or telecommunications common carriers or acts, omissions, overloading or slowdowns over the Internet or any third party Internet service providers.
